North Carolina takes drug offenses very seriously, and the consequences of a conviction for heroin-related charges can be especially severe. Possessing any amount of heroin at all is automatically a felony, but the amount in your possession will determine the specific severity of the charges you are facing.

The consequences increase even further if prosecutors are able to prove that the defendant intended to sell or otherwise distribute heroin to third parties. Law enforcement officers use several factors to determine if the accused intended to distribute. These include:

  • The total amount of narcotics in possession
  • If scales or small baggies are present
  • If the narcotics are in several small baggies
  • The amount of cash the accused has when arrested
  • Other items that might indicate an attempt to sell drugs

Understanding The Potential Penalties For Heroin-Related Charges

Any charge related to heroin is a felony, plain and simple. Possession of heroin is a Class I felony and is punishable by fines, the revocation of one’s driver’s license and up to 12 months in prison.

Possession or distribution of 4 grams to 14 grams is a Class F felony in North Carolina. This is punishable by up to 93 months in prison and a $50,000 fine.

Possession or distribution of 14.01 grams to 27.99 grams is a Class E felony. This carries a maximum sentence of 120 months in prison and up to a $100,000 fine. Possession or distribution of 28 grams or more is a Class D felony. This carries a maximum of 282 months in prison and a $500,000 fine.
